HeavenAddress is an online memorial platform offering a social networking service that allows you to find and connect with loved ones, family members, friends and the greater community and share content. Any personal information that you provide under HeavenAddress' services provided through its network of websites - www.heavenaddress.com, (the Websites) may be collected, used, disclosed and handled by HeavenAddress in accordance with this Privacy Statement.

This Privacy Statement sets out HeavenAddress's policies relating to the collection, use, disclosure and handling of personal information. It applies to your conduct on the Websites and is in addition to, and should be read in conjunction with, HeavenAddress's Terms of Use.

HeavenAddress respects the privacy of Registered Users of the Websites and recognises that you may have rights in relation to your personal information. The following sections describe how we will generally handle personal information and safeguard your privacy.

User Consent

By using or accessing the Websites (including via a HeavenAddress mobile app), you agree to the terms of this Privacy Statement and expressly consent to the collection, processing, use and disclosure of your personal information in accordance with this Privacy Statement.

Collection of Information

We only collect personal information that is necessary for our functions or activities and we do so only by lawful and fair means and in an unobtrusive way. HeavenAddress collects information (which may or may not be personal information) about you in the following ways:

• When you register with or use HeavenAddress, we collect personal information such as your name, email address, telephone number, address, gender and any other personal or preference information that you voluntarily provide to HeavenAddress through the Websites or to a HeavenAddress services partner (which may include our funeral director partners). If you register or login to HeavenAddress via a social networking account, such as Facebook, the social networking site may provide your information to HeavenAddress.
  
  
• When you visit our Websites, we collect your browser type and IP address. This information is gathered for all HeavenAddress visitors and is used to manage the Websites, track usage and improve HeavenAddress Websites and services. In addition, HeavenAddress stores certain information from your browser using cookies.

  Cookies are pieces of data stored on your computer that are sent from the websites that you view. HeavenAddress uses session Cookies, which terminate once you close your web browser, and also persistent Cookies that store your login details to make it easier for you to login the next time you visit HeavenAddress. You can remove or disable Cookies using the settings on your web browser, however, if you choose to do this you may not be able to take full advantage of the functions on the Websites.

  If you have not identified yourself on HeavenAddress's Websites, such as registering or logging in as a Registered User, the information we collect about you remains anonymous.

• When you use the Websites, you may create a Registered User profile, send messages, post content, perform searches, form groups, set up events and otherwise share or transmit information through various channels provided by the Services (as that term is defined in HeavenAddress's Terms of Use). We collect this information so we can offer you more personalised services and features. In most cases, such information will be retained so that, for example, you can return to view past messages you have sent or easily see your list of saved memorials and contacts.
  
  
• When you post Registered User Content (as that term is defined in HeavenAddress's Terms of Use) on the Websites, you do so at your own risk. While HeavenAddress provides security options that allow you to limit access to your profile pages, we cannot and do not guarantee that such Registered User Content will not be viewed by unauthorised persons. HeavenAddress is also not responsible for the circumvention of any security setting or measures contained on the Websites. You acknowledge and agree that copies of Registered User Content may remain viewable in cached and archived webpages or if other people copied or stored your Registered User Content.
  
  
• HeavenAddress may also collect information about you from other sources, such as blogs, instant messaging services and other users of the Websites through HeavenAddress's Services in order to provide more personalised services and features.

Invitations to Non-Registered Users

You may invite family and friends to join HeavenAddress by sending invitation emails through our automated invitation system. HeavenAddress will send them an email inviting them to visit the Websites.

If you choose to send an invitation email, you acknowledge and agree that HeavenAddress will store information needed to send the invitation (such as the email address submitted), to register your referral if they accept your invitation, and to track the success of the referral program. Recipients of invitation emails may contact HeavenAddress at feedback@heavenaddress.com to request removal of their information from our databases.

Use and Disclosure of your Information

HeavenAddress holds, uses and may disclose personal information primarily for the purpose of providing or enhancing our Services to you and providing support or information you may have requested or indicated an interest in receiving. We will not disclose any information about you outside HeavenAddress or its operating companies without your permission unless:

• it is required or permitted by law;
• we receive a bona fide request from an appropriate government or regulatory body or agency;
• we believe it is necessary in order to offer you the Services;
• we suspect that your use of the Websites or Services is in breach of the Terms of Use;
• it is to protect the rights or property of HeavenAddress, @heaven, any HeavenAddress user;
• it is otherwise permitted or contemplated under the Terms of Use; or
• it is to lessen or respond to a serious threat to a person's health or safety, or to prevent actual or suspected fraud or any other actual or suspected illegal activity perpetrated through or in connection with the Websites or Services or otherwise to protect the property of HeavenAddress.

We will not share your personal information with any non-affiliated third party except where permitted or allow a non-affiliated third party to promote its products and services directly to you without your express consent.

There are occasions where we may share your personal information outside your country of residence as part of providing HeavenAddress services. This includes sharing your information with our overseas HeavenAddress companies or staff (which may include Australia, Malaysia, Singapore and Vietnam) in addition to our contractors and third party services providers(which may include overseas contractors or service providers including in Australia, Singapore, the United Kingdom and the United States) who act on our behalf or provide services to us, including data processing and global technology or support services.

Not with standing anything in this Privacy Statement, HeavenAddress reserves the right to transfer your personal information to a successor that acquires rights to such information as a result of the sale of HeavenAddress, a material change in control of HeavenAddress or the sale of substantially all of its assets to that successor.  

Keeping your Information Secure

HeavenAddress will take reasonable steps to safeguard any personal information that we hold about you. Your personal information is stored on secure servers that are protected in controlled facilities.

Our employees and contractors will only have such access as is required for them to perform their duties. However, you acknowledge and agree that HeavenAddress will not be responsible for any unauthorised access to your personal information.

In addition, your information and Registered User details are protected by a password that has been selected by you. It is your responsibility to keep this password confidential and to immediately notify us if there is any unauthorised use of your account by any other person.

Access, correction or deletion of your Information

As a Registered User of HeavenAddress, you may access, modify, correct, delete and/or update your profile information at any time by logging into your account. However, where you use the messaging facilities or other communication features on the Websites to connect with other Registered Users of HeavenAddress, those communications cannot generally be deleted.

HeavenAddress may retain backup copies of any information that you delete for a reasonable period of time, however, this information will not be generally available to other users of the Websites.

You may opt out of any marketing communications and your personal data can be moved to other platforms if you so wish.

Links

The Websites may contain links to other websites. You acknowledge and agree that these websites are not under the control of HeavenAddress and that HeavenAddress is not responsible for the privacy practices of websites linked to our network.

When linking to another website, you should read the terms and conditions and privacy statement of that website before disclosing any personal information. This Privacy Statement applies only to information collected by HeavenAddress.    

Third Party Advertising

You acknowledge that third party advertisers may present advertisements on the Websites and/or set and access cookies on your computer. HeavenAddress does not have access to or control over the cookies that may be placed by third party advertisers.

This Privacy Statement only covers the use of cookies by HeavenAddress and does not govern the use of cookies or other tracking devices by any third party advertisers.

Changes to this Privacy Statement

Your use of HeavenAddress Websites and Services, and any dispute arising from it, is subject to this Privacy Statement and our Terms of Use, including all dispute resolution, limitation of liability and governing law provisions.
